If you do not agree to these Terms, do not access or use the Site or services made available through the platform.
Omni Vita Medical operates exclusively as an administrative and technological platform connecting individuals with independent, licensed healthcare providers and third-party compounding/retail pharmacies.
No Corporate Practice of Medicine : Omni Vita Medical is a technology and administrative services company. Omni Vita Medical does not practice medicine, nursing, or pharmacy, make clinical decisions, prescribe medications, or control the professional judgment of any Provider.
Clinical Independence : All medical assessments, diagnoses, consultations, treatment plans, and prescriptions (including weight management, peptide therapies, hormone optimization, and hair restoration) are performed solely by independent licensed physicians, nurse practitioners, or physician assistants (“Providers”). The Company does not exert control over, or interfere with, the independent clinical judgment of any Provider.
No Provider-Patient Relationship with the Company : Utilizing the Site or communicating with the Company does not create a physician-patient or healthcare provider-patient relationship between you and Omni Vita Medical.
Telehealth involves the delivery of healthcare services using electronic communications, information technology, or other means between a provider in one location and a patient in another.
Jurisdiction & Standards : Your Provider will deliver telehealth services in accordance with the laws and professional standards applicable in the jurisdiction where you are physically located at the time the services are provided.
Location Verification : You agree to accurately state your physical location at the time of any consultation. Services are only available to individuals physically located in jurisdictions where our network Providers are duly licensed to practice.
Informed Telehealth Consent : You acknowledge that telehealth has inherent limitations (e.g., lack of hands-on physical examination). By using the platform, you consent to electronic consultations and acknowledge that telehealth may not be suitable for all medical conditions.
To access our services, you represent and warrant that:
You are at least 18 years of age.
You will provide true, accurate, complete, and updated medical history, health data, and identification documents. Providing false, misleading, or incomplete information regarding your health, current medications, or existing conditions poses serious health risks and constitutes a material breach of these Terms.
You will use prescribed medications strictly as directed by the prescribing Provider and will not distribute, resell, or transfer any prescribed treatments to third parties.
No Prescription Guarantee: Completing an online intake, assessment, or consultation does not guarantee that a prescription will be written. Prescriptions are issued solely at the clinical discretion of the evaluating Provider based on medical necessity.
Compounded Medications: Certain products offered via independent pharmacies (e.g., compounded semaglutide, tirzepatide, peptide formulations) are compounded drug products prepared pursuant to federal law (Sections 503A or 503B of the FD&C Act) and applicable state pharmacy regulations. Compounded drugs are not approved by the U.S. Food and Drug Administration (FDA) for safety or efficacy.
Pharmacy Delivery: Prescriptions are dispensed and shipped directly by independent, licensed compounding or retail pharmacies. Omni Vita Medical is not liable for shipping delays, package damage, or pharmacy fulfillment errors once a prescription is placed with the pharmacy.
Fees: You agree to pay all applicable fees for consultations, medical assessments, and product orders as displayed on the platform at the time of purchase.
Subscriptions: If you enroll in a recurring treatment plan or subscription, you authorize Omni Vita Medical to charge your designated payment method on a recurring basis until canceled in accordance with our cancellation policies.
Refunds: Consultation and assessment fees cover the time and review of the healthcare provider and are strictly non-refundable, regardless of whether a prescription is issued. Product or medication refunds are handled on a case-by-case basis strictly for damaged or incorrectly fulfilled shipments.
Your submission of personal health information (PHI) through the platform is governed by our Privacy Policy and applicable health privacy laws, including the Health Insurance Portability and Accountability Act (HIPAA). By using the platform, you consent to receive electronic communications (including email, SMS/text messages, and portal notifications) regarding your appointments, treatments, and account management.
“As-Is” Provision: The Site and platform services are provided on an “AS IS” and “AS AVAILABLE” basis without warranties of any kind, whether express or implied.
Emergency Medical Care: OMNI VITA MEDICAL IS NOT FOR MEDICAL EMERGENCIES. IF YOU ARE EXPERIENCING A MEDICAL EMERGENCY, IMMEDIATELY CALL 911 OR GO TO THE NEAREST EMERGENCY ROOM.
Liability Cap: To the maximum extent permitted by applicable law, Omni Vita Medical, its officers, directors, employees, and agents shall not be liable for any indirect, incidental, consequential, special, or punitive damages, or for any medical malpractice, negligence, or misdiagnosis resulting from services rendered by independent Providers or pharmacies.
You agree to defend, indemnify, and hold harmless Omni Vita Medical, its affiliates, licensors, and service providers from and against any claims, liabilities, damages, judgments, awards, losses, costs, or expenses (including reasonable attorneys’ fees) arising out of or relating to your violation of these Terms, misuse of the Site or prescribed products, or provision of false medical information.
These Terms and any disputes arising out of or related to your use of the platform shall be governed by and construed in accordance with the laws of the State of Florida, without giving effect to any choice or conflict of law provision.
Any legal suit, action, or proceeding arising out of these Terms shall be instituted exclusively in the state or federal courts having jurisdiction over Pinellas County, Florida.
We reserve the right to revise and update these Terms at our sole discretion. All changes are effective immediately when posted on the Site. Your continued use of the Site following the posting of revised Terms signifies your acceptance of the updates.
